With the advance of the multinational corporations, financial institutions, etc. from developed countries as well as the active marching of laborers from Southeast Asia, China, etc. into Korea, foreigners staying in Korea have remarkably increased and in line with the international era, foreign students wishing to learn Korea are significantly on the rise. Keeping pace with this social and international change, leasing service market targeting foreigners is also becoming larger.
Accordingly, foreigners and foreign students who rent a house for residence in their settled Korea have multiplied, but the measures that can protect thesepeople are lacking in reality. In addition, problems related to lease are appearing in numbers due to the foreigners’ poor skill in Korean, insufficient knowledgeof the laws and ordinances for lease, etc.
Therefore, this study was intended to analyze the problems related to the lease for foreign laborers’ and students’ residence in Korea and also to prepare the measures that can resolve them.
To analyze these, foreign laborers and students dwelling in Korea were selected for the subject of study, and out of 300 questionnaire handout copies 154, excluding the inappropriate 11, were used for the final materials.
As a result of analysis, first, as regards the necessity and recognition of the house lease protection law, to begin with, on the item "I have a good understanding of the house lease protection law," the response was below average, so the recognition level of the house lease protection law by foreigners residing in Korea was somewhat low. However, on the item "I consider the house lease protection law a necessary in foreigner’s lease" it was 4.20, revealing theirhigh perception of its need, except their understanding isthe law is of help to foreigners but more protective for Koreans.
Second, on the item "Lease deposit money is burdensome to my life in Korea," it was high 4.12, showing that to foreigners residing in Korea the deposit money for lease is burdensome.
Third, as a result of questionnaire inquiry related to the coverage and necessity of the house lease protection law, regarding the question "Is it necessary for thehouse lease protection law to be equally applied to illegal foreign residents as the native?" the response was 3.15, an average level, and the result of answering about the necessity of the law showed that most foreigners understand the law is necessary.
Fourth, As a result of the questionnaire inquiry related to the lease deposit money, on the item "I ever thought it fearful that I might not be able to get the lease deposit money back." it was 4.13, high, and on "Legal devices that can protect foreigners are rather unprepared."it was 4.03, implying the need for the legal supplement.
Fifth, as a result of asking about the legal devices related to lease protection, on the question "Is the legal aidcenter for assisting the foreigners ignorant of Korean actuality necessary?" it was shown high 4.45, bringing the necessity for the legal aid center to the fore. As to "I think in case of foreigner’s lease contract, a real estate broker or other legal devices are necessary." it was 4.27 and as to "In case of foreigner’s lease contract, regulations that can secure the opposing power is necessary." it was 4.14, high, indicating that in case of foreigner’s lease contract, regulations for legal device and for securing the opposing power are necessary.
