국 문 요 지 최근 국민소득의 증대와 소규모의 가족형태가 증가함에 따라 동물에 대한 관심이 확대되고 있다. ‘반려동물’이란 용어가 등장하고 있는 것처럼 동물은 인간과 더불어 사는... 국 문 요 지 최근 국민소득의 증대와 소규모의 가족형태가 증가함에 따라 동물에 대한 관심이 확대되고 있다. ‘반려동물’이란 용어가 등장하고 있는 것처럼 동물은 인간과 더불어 사는 존재로 인식되는 단계에까지 이르렀다. 그러나 우리나라 법제에서는 여전히 동물을 물건으로 취급하고 있는 상황으로 최근 SBS TV ‘동물농장’에서 방영된 개 번식장의 사례나 언론에 소개되는 각종 동물 학대 행위, 그리고 병들고 늙은 반려견의 무단 유기 등의 사례에서 볼 때 아직까지 우리나라에서는 동물이 물건 이상의 의미를 가지지 못하고 있다. 현재 우리나라의 동물보호 관련 법률은 『동물보호법』, 『야생생물 보호 및 관리에 관한 법률』, 『문화재보호법』, 『자연환경보전법』등이 존재하지만 많은 부분에 있어 선언적이고 훈시적 의미의 ‘동물보호’ 규정을 가지고 있으며 국민의 동물에 대한 진일보한 인식을 따라가지 못하고 있다. 아울러 동물보호업무에 있어서도 농림축산식품부, 환경부, 문화재청 등으로 분산되어 있어 유기적이고 체계적인 동물보호를 위한 시책을 추진하기 어렵다. 최근 외국의 입법사례에서는 동물을 단순히 ‘보호’의 대상이 아닌 기본적으로 동물을 지각있는 존재로서 이해하는 등의 적극적인 ‘복지’의 대상으로 보고 있고 이를 위한 법적, 제도적 장치 마련을 확대하고 있으며 우리나라에서도 동물보호단체를 중심으로 동물복지의 개념을 반영한 입법적 요구의 목소리가 커지고 있다. 최근 관계 법령의 사각지대에 놓여 있던 동물원 등의 전시동물의 관리 및 복지를 규율하는 법 제정이 이루어 졌으나, 아직까지는 선언적인 의미의 규정에 그치므로 실효성있고 세부적으로 규율할 수 있도록 법안의 보완이 필요하다. 위에서 언급한 여러 상황을 볼 때 동물의 법적 지위를 제고하여 법률에 반영하고 『동물보호법』에 동물복지 개념의 도입을 검토할 필요가 있다. 또한 동물학대 행위유형을 세분화하고 체계적으로 정리함으로써 동물보호 규정의 실효성을 확보해야 한다. 마지막으로 동물보호법의 위상강화를 위하여 동물보호를 포함하여 이용·관리에 관한 국가 동물정책 방향과 목표 설정 및 국가 주요시책의 수립 등의 내용을 규율하는 「동물정책기본법」의 제정을 검토하여야 할 것이다.

Abstract A Study of Legal Policy on Animal Protect Legislations The recent rise in national income and the increasing number of small-size families have resulted in an expanding interest in animals. As the term ‘animal companion’ suggests, animals have come to be recognized as beings that live alongside humans. However, the law in Korea continues to treat animals as mere objects. This is evident from the kind of animal abuse that can be seen in dog-breeding farms as shown on the SBS TV program ‘Animal Farm’, and as ed by the press about sick and aging dogs that have been abandoned. Currently, laws such as the Animal Protection Act, the Wildlife Protection and Management Act, the Cultural Heritage Protection Act, and the Natural Environment Conservation Act do exist in Korea for the protection of animals. In many ways, however, these laws have regulations that are declarative and instructional in meaning and are therefore unable to follow the forward-thinking ideas of Korean citizens about animals. Additionally, work for protecting animals is distributed among the Ministry of Agriculture, Food and Rural Affairs, the Ministry of Environment, and the Cultural Heritage Administration. This makes it difficult to pursue an organic and systematic policy that protects animals. In a recent overseas legislative example, animals were to be regarded as beings with intelligence instead of mere recipients of protection, and hence deserving of proactive welfare. Some foreign countries are expanding legal and institutional strategies for this type of legislation, and even in Korea, there are growing demands among animal protection groups for laws that reflect ideas of animal welfare. A recent law enacted regulates the management and welfare of zoos and other animal display facilities that were previously in the blind spot of relevant Acts and subordinate statutes. However, this regulation is largely declarative in meaning, and therefore supplementary bills are needed for effective and thorough regulation. Looking at the examples mentioned above, it is clear that we need to improve the legal status of animals, reflect on legislation, and consider implementing animal welfare into the Animal Protection Act. We also need to ensure the regulatory efficacy of animal protection laws by systematic organization and by specifying forms of abuse toward animals. Last, we need to elevate the status of animal protection laws by passing legislation for a Framework Act on Animals that regulates the content of conservation initiatives. This would include the direction of national policy regarding the use and management of animal protection laws as well as the establishment of goals. ，免费韩语论文，韩语论文 |
