아동 시기는 신체적, 정신적인 발달에 있어 결정적인 역할을 하는 시기이며 정신적으로 취약한 상태여서 외부환경에 의해 상처받기 쉬운 시기이다. 그래서 사회가 보호하고 관심을 가져... 아동 시기는 신체적, 정신적인 발달에 있어 결정적인 역할을 하는 시기이며 정신적으로 취약한 상태여서 외부환경에 의해 상처받기 쉬운 시기이다. 그래서 사회가 보호하고 관심을 가져야 할 소외계층 중 가장 우선순위에 두어야 한다. 하지만 중국의 전통적인 가정교육관습 때문에 우리는 종종 아동을 그 부모의 소유물처럼 생각한다. 이러한 생각이 아동은 부모의 육체에서 나와 부모의 소유이며 부모는 아동의 운명과 삶의 전반적인 부분을 결정해주며 통제 할 수 있다는 믿음을 만들었다. 이러한 의식구조 때문에 부모의 괴팍한 성격과 불안정한 가정환경이 아이들을 무례하거나 반항적이게 만드는 등의 아동학대형태가 빈번하게 나타나며 아동의 발달에 영향을 주고 있다. 법률제정과 법률 집행은 아동학대 예방에서 가장 핵심적인 간섭조치이다. 아동학대 예방 방면에서 중국은 아직 초기 단계에 머물고 있으며, 선진국과 견주어 보면 아직 거리가 있다는 것을 알 수 있다.본 논문은 문헌종합서술과 사례분석 등 방법을 통해 1992-2012년까지 중국의 아동학대 문헌을 수집하고 중국 아동학대 실태를 분석하여 부족한 부분을 찾거나 발견함으로서 아동학대 방지법률, 법규의 제정과 개선의 근거로 제공할 것이다.

Childhood is a key period for the development of one’s physical and psychological, also it is the period in which one’s soul is very weak and vulnerable to be hurt, so children is the weakest group that need our protect and help. However, due to the chinese traditional concept of children, we often regard children as the personal property of parents’. Children all come from mother and belong to parents; parents can control children’s life and their fate. Additionally, as the factors of parent’s grumpy character, the fragile of family structure, children’s naughty and rebellious, and so on ,the child abuse is common in the family, and affects on children’s development. Legislation and enforcement and law is the key solution of child maltreatment prevention. China is at the primary stage of child maltreatment prevention and intervention and has big gap with developed counties. We searched for literatures about child abuse problems and regulations from 1992 to 2012 to collect comprehensive valuable and representative date in China. Through analyze the current situation, limitations and gaps will be identified in terms of child protection in China.
