본 연구는 UN아동권리협약 아동권리 조항 중 제31조 아동의 놀이와 휴식, 여가와 문화생활 권리에 대한 국가보고서 내용과 아동권리지표를 기초로 아동권리협약 제31조 중 국내 아동의 여가... 본 연구는 UN아동권리협약 아동권리 조항 중 제31조 아동의 놀이와 휴식, 여가와 문화생활 권리에 대한 국가보고서 내용과 아동권리지표를 기초로 아동권리협약 제31조 중 국내 아동의 여가와 문화생활 이행 실태 분석을 통해 아동권리협약 제31조 권리를 보장하기 위한 방안을 모색해보고 정책 수립을 위한 기초자료를 제공하는데 목적이 있다. 연구의 목적을 달성하기 위해 다음과 같은 연구문제를 설정하였다. 첫째, 아동권리협약 조항 중 제31조에 대한 국가보고서 내용은 어떠한가? 둘째, 아동권리협약 제31조 중 국내 아동의 여가와 문화생활 이행 실태는 어떠한가? 셋째, 아동권리협약 제31조 권리를 보장하기 위한 방안은 무엇인가? 이를 위해 UN아동권리위원회에 제출한 1차～4차 국가보고서와 UN아동권리위원회의 권고사항, 아동관련 행정부처인 보건복지부와 여성가족부, 문화체육관광부에서 실시한 실태조사 자료를 기초로 문헌연구와 내용분석법을 병행하였다. 본 연구에서 얻어진 주요 결과는 다음과 같다. 첫째, 아동권리협약 조항 중 제31조에 대한 1차～4차 국가보고서에서는 청소년의 여가와 문화활동을 위한 시설의 설립과 설치 확대 및 활동프로그램 개발·보급,「청소년활동진흥법」과「문화예술교육지원법」등 관련법 추가 등 정부의 노력과 계획 위주로 서술되어 있다. 반면, NPO민간보고서에서는 아동들의 시설 이용과 프로그램 참여 저조에 대한 원인 및 아동의 놀 권리 보장을 위한 방안을 강구하여야 함을 제시하였다. 그러나, 국가보고서에서는 아동권리협약 제31조 아동의 놀이와 휴식, 여가와 문화활동 권리를 보장하기 위한 명확한 방안이나 이행 실태에 대해 제시되어 있지 않다. 둘째, 2011년 UN아동권리위원회로부터 아동권리협약 제31조 권리 이행에 대한 권고를 받은 후 국내 아동의 여가생활(아동의 하루 평균 여가시간, 청소년단체 가입률, 자원봉사활동, 여가만족도)과 문화생활(아동의 연간 공연관람률, 평균 독서량, 평균 여행경험률) 이행 실태는 연도별·연령별 미미한 증가와 감소차를 보이고 있다. 하지만, 아동의 여가와 문화생활을 위한 시간은 여전히 부족하다는 결과를 보이고 있다. 특히, 학년이 올라갈수록 아동의 여가와 문화생활을 위한 시간은 상당히 부족함을 볼 수 있다. 이는 입시위주의 학업으로 인한 아동들의 일과가 학교 정규과정 이외에 사교육으로 이어지기 때문으로 볼 수 있다. 셋째, 아동권리협약 제31조 권리를 보장하기 위한 방안을 모색해보면 우선 아동이 놀이와 휴식, 여가와 문화활동에 참여할 수 있도록 시간을 보장해 주어야 한다. 입시위주의 학업중심과 경쟁상황에 처해있는 아동이 가장 많은 시간을 보내고 있는 학교에서만큼은 탄력적인 교육과정 운영으로 아동의 놀이와 휴식, 여가와 문화생활 권리가 보장받을 수 있도록 제도적 확립이 요구된다. 또한 현재 보건복지부와 여성가족부, 문화체육관광부 등 여러 부처로 분산되어 있는 아동관련 부서를 통합하거나 아동전담 부서 및 기구를 설치하여, 연령별 아동의 객관적이고 실증적인 기초 자료를 수집해야 할 것이다. 그리고, 아동복지법과 청소년기본법, 청소년활동법, 문화진흥법 등 다양한 아동관련 법들도 제·개정 과정을 통해 아동전담법을 신설하여, 법적으로 아동의 놀이와 휴식, 여가와 문화활동 권리를 보장받을 수 있도록 구체적으로 명시되어야 할 것이다. 주제어 : 아동권리협약, 권리, 이행

The purpose of this study is to provide the basical data helpful to establish the national policy and strategy for implementation of the UN Convention on the Rights of the Child in Korea focusing on article 31(the article 31 rights), ensuring children’s right to rest, leisure and play, cultural life and arts. Therefore analysis of the Korea national s(1994-2008) on implementation submitted to the UN Committee(1994-2008) was carried out. To achieve our objectives, three key areas are analyzed: First, review on the country on the UN Convention on the Rights of the Child, especially article 31? Second, current status of the national on implementation of leisure and cultural life of article 31? Third, strategy and action plans to ensure article 31 rights of child? Results obtained are shown as follows: First, the national s(1994-2008) describe about setting up cultural centers and various programs associated with the rights of children. Korean governmenat’s efforts and various planning are also mentioned. However the does not contain clear approaches to insure the right of the child. Non Profit Organization s also point out low participation of the children and urges the government to take actions to remedy the situation. Second, since 2011 when the UN Committee on the Rights of the Child issued recommendation, participation in leisure and cultural activies have been declining. Recommendation: First, ensure that children have time to rest, leisure and play, cultural life and the atrs. Second, we need to have a national educational system which allows the school to have an authority implementing flexible schedules, so that children should be able to enjoy article 31 rights of child. This part is critically important because of heavy pressure of entrance-exams and extremely competitive environments in Korea. Third, many government offices and agencies such as Ministry of Health and Welfare, Women and Family Affairs. Ministry of Culture, Sports and Tourism are involved in handling children’s agenda. To provide a consistent, comprehensive and inclusive approach to the implementation of article 31, there is need to create one single organization focusing on the child issues.
